The Standard Traffic Ordinance as adopted is hereby modified by adding thereto the following:

        The governing body may, by resolution, establish and fix the location of such traffic control devices as may be deemed necessary to guide and warn traffic under the provisions of this chapter, other traffic ordinances and the state laws. The city shall place and maintain such traffic control signs, signals and devices when and as may be required by the authority of the governing body to make effective the provisions of this chapter and other ordinances for the regulation of traffic. Any official traffic control device placed pursuant to this section shall be marked and labeled on a map of the City of Osborne for the purpose of displaying all such traffic control devices and shall be filed with the city clerk to be open to inspection and available to the public at all reasonable hours of business.

(a)   It shall be unlawful for any driver of any vehicle to use or operate or cause to be used or operated within the city limits of Osborne, Kansas, any mechanical exhaust device designed to aid in the braking or deceleration of any vehicle which results in the excessive, loud, unusual or explosive noise from such vehicle, also known as engine braking.

(b)   Any person found guilty of engine braking in violation of this section is guilty of a traffic infraction punishable by a fine which shall be fixed by the court, not exceeding $500.00 for each violation.

(c)   The city shall post or cause to be posted in a conspicuous place signs clearly stating that the use of engine braking is prohibited by city ordinance.

It shall be unlawful to park, place, deposit, leave unattended, or to cause or permit to be parked, placed, deposited, or left unattended, upon any street, drive, avenue, alley, public way or right-of-way within the corporate limits of the City of Osborne, Kansas, any commercial truck, farm truck or any other truck licensed and registered for gross weights greater than 24,000 pounds.

It shall be unlawful for any person or persons to ride a bicycle on any public sidewalk on either side of First Street between Washington Street and Vermont Street; on any public sidewalk on either side of Second Street between Washington Street and New Hampshire Street; and on any public sidewalk on either side of Main Street between Third Street and Elm Street.

It shall be unlawful for any person or persons to ride or use skateboards, roller skates, roller blades, coasters or other similar devices on any public sidewalk on either side of First Street between Washington Street and Vermont Street; on any public sidewalk on either side of Second Street between Washington Street and New Hampshire Street; and on any public sidewalk on either side of Main Street between Third Street and Elm Street.

It shall be unlawful for any person to drive or operate a commercial truck, farm truck or any other truck licensed and registered for gross weights greater than 24,000 pounds, whether loaded or unloaded, inside the corporate limits of the City of Osborne, Kansas, except as follows:

(a)   All commercial, farm or other trucks entering, operating within or passing through the City of Osborne, Kansas, shall use only the following streets and highways;

(1)   U.S. Highway 24

(2)   First Street (U.S. Highway 281)

(3)   Main Street

(4)   West Adams Street from First Street to Sixth Street

(b)   Commercial trucks shall include all vehicles licensed and registered for gross weights greater than 24,000 pounds, whether loaded or unloaded, and shall include vehicles commonly referred to as semi-tractors and truck tractors, with or without trailers. Freight trucks, concrete or service trucks having a destination in a district zoned commercial, industrial or residential within the city limits and which is not on a designated truck route may travel on non-truck-route designated streets using only the shortest and most direct route to the destination in such district zoned commercial, industrial or residential for the immediate loading or unloading at a residence or business establishment.

(c)   Owners of agricultural land located within the city limits may use streets having the most direct route from the agricultural property to the above described streets and/or highways.

(d)   The fine for a first violation of this section shall be not less than $100.00 nor more than $500.00. Any person found guilty of a second or subsequent violation within three (3) years of any such prior conviction shall pay a fine not less than $250.00 nor more than $500.00.
