CHAPTER 12. PUBLIC PROPERTYCHAPTER 12. PUBLIC PROPERTY\Article 7. City Hiking and Biking Trails

(a)   Authorized and prohibited uses: Hiking and biking trails situated on city property shall be limited to use by pedestrians and persons using nonmotorized vehicles only. Pedestrian users of such facilities shall always have the right of way as between themselves and non-motorized vehicle users.

(b)   Exceptions:

(1)   The use of motorized vehicles and equipment on hiking and biking trails situated on city property is permitted by duly authorized persons for the purpose of maintaining such facilities, specifically involving the use of riding and walk behind lawn mowers, all terrain vehicles (ATVs), micro-utility trucks and work-site utility vehicles.

(2)   The public use of motorized vehicles on hiking and biking trails situated on city property may be permitted on a case by case basis for activities sanctioned by the city’s governing body and upon the applicant’s receipt of a permit giving prior authorization for such activity.

(c)   Penalty: Violation of this article by any person, whether through the use of a motorized vehicle or equipment on hiking and biking trails situated on city property without the receipt of prior authorization allowing such use, shall result in such person being subject to a fine of not less than $200.00.
