(a) Tattoo, Tattooed, Tattooing - Refers to any method of placing designs, letters, scrolls, figures, symbols or any other marks under the skin with ink or any substance changing the coloration of the skin by the aid of needles or other instruments designed to touch or puncture the skin.
(b) Tattoo Establishment. - A place where tattooing is performed.

(a) The Governing Body of the City of Osborne, Kansas, may adopt rules and regulations, as well as changes to Rules and Regulations, governing the operation of Tattoo Establishments within the City Limits of Osborne, Kansas.
(b) Copies of such Rules and Regulations will be made available for inspection by the City Clerk during the City’s regular business hours.

The license for a tattoo establishment shall be $100.00 per year. The License shall expire one year from the date of issuance. No one may operate a Tattoo Establishment without a license. No license shall be issued until the Tattooing Establishment has been inspected by the City of Osborne, Kansas, or its designee.

No person under the age of eighteen years of age shall receive a tattoo without the prior, written, signed and notarized consent of the parents of said juvenile. Said written consent shall be permanently retained by the tattoo license holder.

Violation of any section of this article or the Rules and Regulations governing Tattoo Establishments adopted from time to time by the City of Osborne, Kansas, is a misdemeanor, punishable by a fine of not less than $100.00 nor more than $500.00 and/or by no more than thirty (30) days in jail. In addition to any fine or jail time, the permit of any Tattoo Establishment or person performing tattoos may be suspended or revoked by the City of Osborne, Kansas, and/or the Municipal Court.
